Yearly income tax return

All the tax non-residents in Spain who owns a property located in this country must complete and file every year the Income Tax Return (Tax Model 210) for imputed real estate income. This tax is calculated conidering the cadastral value of the property, the municipality of the Spanish property and the country of tax residency of the tax payer. The tax rate for tax residents in the European Union, Iceland, Norway and Liechtenstein is 19% and for non European tax residents is 24%.

This tax return can be submitted from January 1st to December 23th in relation with the imputed income of the previous year. That means that in 2025 it will be submitted the non-residentes tax returns for imputed real estate income regarding tax year 2024.

Every owner must file an individual tax return in proportion with their percentage of ownership.

In case that the property has been rented during the year, the imputed real estate income will be calculated considering only the days that the property hasn't been rented.

Rental tax returns

All the tax non-residents in Spain who rent a property located in Spain must file this tax returns once a year for the profit obtained in the ended year. This tax return must be filed by the owner the next 15 days after the end of the year. This between January 1st and 15th.

The general rule is that tax non-residents in Spain must pay taxes for the income at a flat rate of 24%. However, the tax residents in countries of the European Union, Norway, Iceland and Liechtenstein can deduct the expenses related with the rental (as IBI and rubbish taxes, commisions, gardener expenses...) and apply a flat tax rate of 19%.

In case that the result of the tax return is negative (more expenses than income), it is not necessary to complete and file the quarterly tax return. However, it is necessary to file a yearly tax return in january next year to inform the Tax Authorities of the negative income.
