This Privacy Policy applies when you use Holatax's services, our website and when you contact us using the means we make available to you (form, email and social media), and through it, in accordance with our commitment to transparency, we inform you about the data we collect and what we use it for.

Holatax treats data lawfully, fairly and transparently. It only processes data that is appropriate, relevant and limited to what is necessary in relation to the particular, explicit and legitimate purposes for which it obtains it, and does not treat it for purposes incompatible with them.

This Policy is permanently accessible through the link enabled on the website, called "Data Protection", and may be updated at any time, either as a result of a regulatory change or by changing the configuration of the services or the type of business developed. Modifications that involve changes in the provision of the contracted service, or require the consent of the interested parties, will be communicated in advance of fifteen calendar days so that the interested parties can express their opposition to the processing of their data according to the change described, or so that customers can take the measures they deem appropriate in relation to the modification communicated. For what purpose and legitimacy do we process your data?

To access and/or browse the website of holatax.es it is not necessary to provide any data. The mandatory nature of the answer to the questions that are asked, or of the data requested through the website, is indicated by the incorporation of an asterisk (*) after the question or field of the form. If the required data is not provided it will not be possible to provide the requested service or functionality.

Registration as a user is only allowed through the website holatax.es elderly persons with full capacity to act in legal traffic.

At Holatax we process the information recorded in accordance with the following purposes:

• Customers: the data provided when registering as a user, those collected by any of the means or contact channels identified on the website (including, chats or phone calls), and those collected through the services of Holatax, are used for the purpose of managing the account and services contracted by users, both technically and at the accounting, tax and administrative level, and / or to notify them of incidents or any information of interest about their services. For this purpose and in compliance with tax and data protection regulations, the billing data provided by users are checked, checking the data quality service of the tax administration, and rectifying those data that turn out to be inaccurate. The legitimizing basis of the processing is the provision of the service or execution of the contract.

• Traffic and location data: Holatax retains the data generated in the framework of the provision of electronic communications services, available to the competent authorities, in accordance with Law 25/2007, of 18 October. This data is not used for commercial promotion purposes. The legitimizing basis for the processing is compliance with a legal obligation.

• Abuse: the data provided when reporting a complaint are used for the purpose of analyzing the case, providing the corresponding response and crediting compliance with the obligations associated with its management, as well as for the defense in potential claims. The legitimizing basis of the processing is consent.

• Automated posting on social networks: Users using the automated social media publishing service must provide their access keys (username/email address and password) to those networks. These keys are used for the sole purpose of publishing on behalf of users the contents that they provide. Such contents must respect both the current legislation and the conditions of use of the social networks themselves. The legitimizing basis of the treatment is the provision of a service.

• Notifications on data protection and exercise of rights by data subjects: the data provided is used for the purpose of managing security-related incidents and notifications in accordance with data protection regulations. The legitimizing basis of the processing is the fulfillment of a legal obligation and the data will be kept for the time necessary to fulfill the purpose for which they were collected and to determine the possible responsibilities that may arise from that purpose and the processing of the data.

Holatax will only process the personal data of the interested parties in accordance with the purposes described in this Policy and in the General Conditions of Contract of the services contracted in each case. Data subjects are informed of the processing of their data in the terms indicated above by accepting this Privacy Policy when registering as a Sorella user, or by contracting the specific service that requires such processing in accordance with the General Conditions of Contract of the corresponding service.

Users should refrain from providing personal data of other data subjects, unless they have the relevant authorization, according to which such data subjects have been prior and duly informed about the content of this Privacy Policy and, in particular, who consent to their data being provided to Sorella to be processed in accordance with the appropriate purposes.

User accounts created in violation of any prohibition provided for in this Privacy Policy, in the Conditions of Access and Use of the Website or in the General Conditions of Contract will be desed immediately, unless it must be properly blocked for the formulation, exercise or defense of claims.

How long do we keep the data?

The data provided and collected will be processed solely and exclusively for the necessary time and for the purposes for which they have been collected at all times, as well as to determine the possible responsibilities that may arise from the purposes of the processing. Sorella has established different retention periods depending on the type of data and the applicable purpose of its processing. The applicable deadlines, unless a different period is specified in the General Conditions of Contract of the corresponding service, shall be:

• Customers: the data will be kept for as long as the contractual relationship is maintained, plus an additional maximum period of 6 years after the end of the contract, in application of civil, commercial and tax legislation, unless they must be kept blocked for the formulation, exercise or defense of claims.

• Abuse: The data will be kept for 12 months, unless it must be kept blocked for the formulation, exercise or defense of claims.

• Automated publication on social networks: the data will be processed as long as the functionality is not disabled by the user.

• Notifications on data protection and exercise of rights by data subjects: the data will be kept for the time necessary to fulfill the purpose for which they were collected and to determine the possible responsibilities that may arise from this purpose and the processing of the data.

To which recipients will the data be communicated?

Holatax does not communicate personal data to third parties, unless a rule with a law range provides otherwise or if necessary for the provision of the contracted service.

Holatax may communicate personal data to the competent authorities: tax and customs, judicial, law en forces and state security forces, and any other recipient that, depending on current regulations, is applicable.

In relation to the communications necessary for the provision of the contracted service, those data essential to manage the request of the users and provide the contracted services will be communicated, indicating in the corresponding General Conditions of Contract the terms in which such data are communicated and the identity or category of recipients. In any case, depending on the method of payment you select, it will be necessary to communicate to the financial and banking institutions the relevant data to proceed with the collection of the services.

In the event that a user leaves a comment or interaction socially with the social networks in which Holatax is present, he must keep in mind that his data will be published in the environment in which he acts, that is, he will be expressly authorizing the communication of his data - associated with the action he performs - to the other users who access the social network.

The data we process is only stored on our premises or on the premises of our service providers.

What are your rights in relation to your data?

You have the right to obtain confirmation of whether or not we are processing personal data concerning you, to access your personal data, and to request the rectification of inaccurate data or to complete incomplete data.

You also have the right to request the deletion of your data when, among other reasons, the data is no longer necessary for the purposes that were collected.
